These terms govern use of the PaintIQ platform at paintiq.io, operated by Smith & Co Group Pty Ltd (ABN 55 867 351 534) ("PaintIQ", "we", "us"). By accessing or using the platform you agree to these terms on behalf of yourself and, where applicable, the company whose workspace you use.
PaintIQ is a business management platform for painting contractors covering estimating, site execution, timesheets, subcontractor management, progress claims, reporting and an AI assistant. Features may change as the platform develops. We aim for high availability but do not guarantee uninterrupted service.
The platform includes AI features, including the Halo assistant, which draft documents, triage communications, build reports and propose actions from your workspace data. AI output can contain errors. Proposed actions require human approval before they are carried out, and you are responsible for reviewing AI-generated content, including financial documents such as claims and payment schedules, before relying on it or sending it to a third party.
The platform helps prepare documents such as progress claims, payment schedules, invoices (including recipient-created tax invoices) and safety records. Your company remains responsible for the accuracy of these documents and for its own compliance with applicable law, including building and construction industry payments legislation, tax law and workplace law. PaintIQ is a tool, not legal, accounting or financial advice.
Where fees apply, they are as agreed with your company in writing. We may suspend workspaces with overdue accounts after reasonable notice.
Nothing in these terms excludes rights that cannot be excluded under the Australian Consumer Law. Subject to that, the platform is provided "as is", and to the maximum extent permitted by law our total liability in connection with the service is limited to the amount paid by your company for the service in the twelve months before the claim arose, and we are not liable for indirect or consequential loss, including loss of profit or business interruption.
Your company may stop using the service at any time. We may suspend or terminate access for material breach of these terms. On termination, we will provide a reasonable opportunity to export workspace data.
These terms are governed by the laws of Queensland, Australia. We may update these terms from time to time; the date above reflects the current version, and material changes will be notified inside the platform.
